What is a BOC-3 filing?

A BOC-3 (Designation of Agents for Service of Process) is the form every interstate motor carrier, freight broker, and freight forwarder must file with the Federal Motor Carrier Safety Administration (FMCSA). It designates a process agent in each state where you operate — a person authorized to receive legal documents, court papers, and subpoenas on your behalf and forward them to you.

No filed BOC-3 means no operating authority: FMCSA will not grant your MC number until a blanket process agent designation covers every state you run in. Most new carriers file blanket coverage through a process agent service, which designates one agent network across all 48 contiguous states in a single filing.

Who needs a BOC-3?

For-hire motor carriers

Trucking companies hauling freight across state lines need a BOC-3 on file before FMCSA issues operating authority.

Freight brokers

Brokers of interstate property must designate process agents in every state they arrange freight from.

Freight forwarders

Interstate freight forwarders are held to the same BOC-3 requirement as carriers and brokers.

If you applied for interstate operating authority — new entrant or veteran — a current BOC-3 must stay on file for as long as your authority is active.
